Does an old Turkish address block the 20-year exemption?

An old Turkish address left in the population register does not end the claim, provided the years abroad can be documented.

The strictest condition of Türkiye's 20-year exemption for foreign-source income is this: the person must have had no residence registered in Türkiye during the three calendar years before becoming a Turkish tax resident.

Read literally, that condition closed the door on a large part of the Turkish diaspora. Very few people visit a population directorate to cancel their address when they leave the country. Someone who moved to London, Dubai or Berlin a decade ago may still appear in the register at a flat in Istanbul.

On 13 October 2026 the Revenue Administration answered the question in a private ruling, and the answer favours citizens living abroad.

Istanbul Tax Office, ruling E-62030549-120-1372289 of 13 October 2026.

Where the problem comes from

Under the Income Tax Law, a person whose residence is in Türkiye is treated as resident there. The concept of residence refers back to the Civil Code and means the place where a person lives with the intention of settling permanently. In practice, the administration looks at the population register.

An old Turkish address left in that register therefore looked like a breach of the three-year condition, which would have excluded people who had in fact been living abroad for years, purely because of an administrative record.

The administration's view

The applicant had become resident in Türkiye on 24 August 2026 but had an address registered in Türkiye during the earlier calendar years. The question was whether the actual centre of life and the intention to settle would be taken into account.

The administration relied on General Communiqué No. 210 on income tax, which states that citizens holding a residence or work permit abroad have their personal and economic ties concentrated in that country, so their residence is accepted to be there. The ruling concludes:

Where a Turkish citizen can document that, during the periods in which an address was registered in Türkiye, they held a work or residence permit abroad and lived abroad for more than six months, their residence is accepted as being abroad in principle, and the existence of a Turkish address does not amount to a breach of the condition that no residence was held in Türkiye in the three preceding calendar years.

The administration attaches one requirement: the person must document a definitive return to Türkiye on or after 1 January 2026.

What has to be documented

The ruling leaves the burden of proof squarely with the taxpayer. The file should contain:

  • A foreign residence or work permit covering the relevant calendar years
  • Records showing more than six months spent abroad in each of those years, such as border crossing records, visas and travel documents
  • Evidence of tax residence in the other country
  • Evidence of the definitive return and of the date of settlement in Türkiye

These documents form the backbone of the file submitted to the tax office with the Exemption Certificate application.

The limits of the ruling

Three points deserve attention.

First, a ruling issued under article 413 of the Tax Procedure Law protects only the taxpayer who asked for it. It is not a general regulation. The administration would be expected to reach the same conclusion in a comparable case, but in borderline situations obtaining a ruling in your own name is the safer course.

Second, the reasoning is specific to Turkish citizens and rests on the logic of foreign residence and work permits. It is not clear that a foreign national with a Turkish address registration would be treated the same way.

Third, the ruling concerns the residence condition alone. A tax registration in Türkiye during the last three calendar years arising from employment, business or professional activity remains a separate and strict bar. Only registrations arising from rental income, investment income or capital gains are expressly harmless.

Timing

The exemption does not apply automatically. An Exemption Certificate must be obtained from the tax office by the end of the calendar year in which the person becomes resident. For anyone treated as resident during 2026 the deadline is 31 December 2026, and those settling in November or December 2026 have until the end of February 2027. A late application is refused.

In short

The Revenue Administration takes the view that a Turkish address registration does not breach the three-year residence condition of the 20-year exemption where the person held a foreign residence or work permit and lived abroad. The position must be documented, as must the return to Türkiye.
