Turkish rental income: does a nonresident owner need to file a return?

Whether a nonresident landlord must file in Türkiye depends on the rental income, any tax withheld and the exemptions available for that year.

When a Turkish return may be required

If you are a nonresident individual receiving rent from property in Türkiye, Turkish income tax and filing obligations may still arise. Neither a foreign passport nor payment into an overseas account provides a general exemption. The answer depends on your tax residence, the type of rental income, applicable exemptions and whether tax has been withheld.

The Turkish Revenue Administration’s rental-income guidance distinguishes residential rent from other rental arrangements and explains the particular treatment of nonresidents. The income year must be identified before applying any figures or filing dates.

Where you live and how the property is used

The review starts with where you lived during the year and whether the property was used as a home or for business. Residential and commercial lettings can receive different tax treatment. Joint ownership, a change of tenant or a period without rent can also change the information needed for the calculation.

Owning a Turkish apartment does not, by itself, answer every tax-residence question. Conversely, living overseas does not make the rent from that apartment foreign-source income for Turkish purposes. Your residence country may also require reporting; any treaty or foreign tax relief needs a separate review.

Rent on which the tenant has withheld tax

GİB states that nonresidents do not file an annual return for rental income wholly taxed through Turkish withholding. This rule applies only when its withholding conditions are met. A company tenant or a net rent clause does not, on its own, establish that tax was withheld.

Residential rent requires a separate check of the relevant year’s exemption and its conditions. Other rent not covered by withholding or an exemption requires separate analysis. A return is not necessarily required in every case, but the conclusion should follow from records rather than an agent’s verbal assurance.

Records needed for the calculation

  • The lease, amendments, ownership share and dates of actual letting.
  • Rent receipts, bank statements and a reconciliation of amounts received.
  • Documents showing any Turkish tax withheld by the tenant.
  • Expense records, prior returns and tax-office correspondence.
  • Residence information and any declaration already made abroad.

Deductibility depends on the expense method and its conditions; a payment alone does not establish a deduction. GİB’s publications catalogue includes a February 2026 guide specifically for nonresident landlords. Its calculations should be read against the income year under review.

Other questions from overseas landlords

Does the new 20-year exemption cover my Turkish apartment’s rent?

No. Article 20/D concerns qualifying foreign income of eligible residents; it does not turn Turkish property rent into exempt foreign income. See the law introducing the regime.

Can I check a missed return while abroad?

Yes. The records and any tax-office notice will help establish the filing or correction route. An earlier return does not resolve obligations for later years.
